GLOWISH is a trademark of Infinity Brands S. de RL de CV, known as “INFINITY BRANDS”, with headquarters at Calle Tomás V. Gómez 182, Ladrón de Guevara, CP 44600 Guadalajara, Jalisco, Mexico, Federal Taxpayer Registry IBR2404012KA, hereby offers the terms and conditions that govern the use of the website www.glowish.mx and its electronic application (“website”). Therefore, any person who uses the website or purchases GLOWISH products (hereinafter, “User”) must comply with the provisions of this document.

Effective date:

These terms and conditions will be effective as of April 2024.
We reserve the right to modify, update or otherwise change these terms and conditions at any time without notice. Such modifications will take effect immediately upon posting on this page. It is the user's responsibility to periodically check this page for any changes. Your continued use of the website following the posting of any changes will constitute acceptance of those changes.

Intellectual property:

The contents of the screens related to GLOWISH Products, as well as the programs, databases, networks and files that allow the User to access and use the Site, together with the brochures, instructions and other materials, are the property of GLOWISH and are protected by international laws and treaties on copyright, trademarks, patents, models and industrial designs. Any misuse or reproduction in whole or in part of said contents is prohibited, except with the express written authorization of GLOWISH.
The Site may contain links to other websites, which does not imply that they are owned or operated by GLOWISH. Since GLOWISH has no control over such sites, it shall not be liable for the content, materials, actions and/or services provided by them, nor for any damage or loss caused by their use, whether directly or indirectly. The presence of links to other websites does not imply an association, relationship, approval or endorsement by GLOWISH of such sites and their content.

System or Database Violations:

Any action or use of any device, software or other means intended to interfere with the activities and operations of GLOWISH or with the descriptions, profiles or databases of GLOWISH is prohibited. Any interference, attempt or activity that violates or is contrary to the laws on intellectual property rights and/or the prohibitions established in this contract will make the person responsible subject to the relevant legal actions and the sanctions provided for in this agreement, as well as being responsible for compensating any damages caused.

System failures:

GLOWISH assumes no liability for any damage, harm or loss suffered by the User as a result of failures, lack of availability, accessibility or interruption in the system, the server or the Internet. It shall also not be liable for any virus that may infect the User's equipment due to access, use or examination of its Website, or as a consequence of any transfer of data, files, images, text or audio contained therein. Users may not attribute any liability or demand compensation for loss of profit due to damages arising from technical difficulties or failures in the systems or the Internet.

GLOWISH does not guarantee continued or uninterrupted access to and use of its Site. The system may occasionally be unavailable due to technical difficulties, Internet failures or any other circumstance beyond the control of GLOWISH; in such cases, an effort will be made to restore the service as quickly as possible, without this implying any liability on the part of GLOWISH. GLOWISH shall not be liable for any errors or omissions in the content of its Website.

Jurisdiction and applicable law:

This agreement shall be governed in all its points by the laws in force in the Republic of Mexico. Specifically, with respect to data messages, electronic contracting and electronic commerce, it shall be governed by the provisions of the corresponding federal legislation. Any dispute arising from this agreement, whether its existence, validity, interpretation, scope or compliance, shall be subject to the applicable laws and the competent Courts.
For the interpretation, compliance and execution of this contract, the parties expressly submit to the jurisdiction of the competent courts of Guadalajara. Consequently, they waive any jurisdiction that, due to their present or future domicile, may apply to them.

Order Process:

Once the products have been selected, GLOWISH allows the User to view the amount to be paid, the selected products and estimates the delivery time.
The price that the buyer will pay includes the value-added tax, and the site also breaks down the cost of home delivery.
It is the sole responsibility of the User to validate the information provided before confirming the order or proceeding with the purchase.
To proceed with payment, the User must accept having received the quote with the costs previously itemized.

Pay:

The User must make payment for the Products based on the order confirmation indicated in the previous point. Any payment that the User must make for GLOWISH products will be made by associating the Payment Methods that the User selects from those available on the Website.
It is the User's responsibility to verify that their selection is appropriate, as well as the amount to be paid according to the quote.
The User must select the Payment Method from those available, provide their details for payment and, once payment has been made, payment confirmation will be sent to their email. It is the User's responsibility to verify that their selection is correct, as well as the amount to be paid.
All information provided by the User shall be his/her sole responsibility, and the User shall guarantee its veracity.

Payment Methods: We accept the methods available on our website. All payments must be made in the currency specified at the time of purchase.
Payment Security: We take the security of your payment details seriously. All payments made through our website are secure and protected using SSL encryption technology to ensure the confidentiality of your information.
Checkout Process: Once you have selected the products or services you wish to purchase, you will be directed to our secure checkout process. Here, you will be required to provide the information necessary to complete the transaction, including your payment method details and your billing address.
Payment Confirmation: After completing the checkout process, you will receive an order confirmation via email. This confirmation will include the details of your purchase as well as a unique order number for your reference.
Payment Authorization: By making a payment through our website, you expressly authorize the corresponding charge to be made to your account or payment card. You must ensure that you have sufficient funds available to complete the transaction.

Payment Declines: We reserve the right to decline any payment we deem suspicious or fraudulent. In the event your payment is declined, we will notify you by email and provide instructions on how to resolve the situation.

Shipment:

Shipping Policy: All orders will be processed and shipped within 90 business days of the purchase date, unless otherwise specified. Shipping costs and estimated delivery times will be calculated at checkout, based on destination and shipping method selected.
Delivery Address: It is the customer's responsibility to provide accurate and complete delivery address information at the time of purchase. We are not responsible for delays or non-deliveries due to incorrect or incomplete address information provided by the customer.
Shipping Methods: We offer several shipping methods. Available shipping methods may vary depending on destination and shipping address.
Delivery Confirmation: Once your order has shipped, you will receive a shipping confirmation email with tracking information. Please track your package using the tracking number provided to ensure timely delivery.
Delivery Delays: While we make every effort to ensure timely delivery of your order, we are not responsible for delays caused by factors beyond our control, including but not limited to weather conditions, natural disasters, carrier delays, and customs clearance procedures.
Accepting Delivery: Upon receiving your order, please inspect the package for any damage or discrepancies. If you notice any issues with your delivery, please contact us immediately to report the problem and initiate a resolution.
Returned Deliveries: If you refuse delivery of an order or do not receive it from the carrier after several delivery attempts, the order may be returned to us. In such cases, additional shipping charges may apply to resend or cancel the order.
Shipping Restrictions: We reserve the right to restrict shipping to certain locations or countries based on legal restrictions or carrier limitations. Please see our shipping policy for more information on shipping restrictions.
Shipping Fees: Shipping fees are non-refundable unless otherwise specified. In the event of a return or exchange, the customer may be responsible for return shipping costs.

Termination of contract:

The terms and conditions are available to the User upon entering the Site and can be consulted at any time. The User must agree to them before sending information and, in general, when starting the process of purchasing the products.
The consideration will be settled in accordance with the payment section of these terms and conditions. GLOWISH may terminate the contract early if:
• Payment is not approved. In this case, the parties expressly agree that failure to make full or partial payment will result in automatic termination of the contract.
• The User fails to comply with any of the obligations assumed in this document.

Warranty:

Any warranty referred to in the terms and conditions or on the GLOWISH website, in respect of the Products it provides and their results, shall be subject to the following conditions in order to be valid:

  1. The User must provide information, images and any requirements requested by GLOWISH in a truthful, real and verifiable manner.
  2. The Product must not be altered, damaged or modified in any way.
  3. The Product must be used in accordance with its nature.
  4. The Product must be used, installed and/or employed according to the instructions in the Manual.
  5. The product warranty will only apply if it is expressly stated on the website, in the description of each product, and if it is exercised against GLOWISH in accordance with the terms of this clause. Any warranty claim against GLOWISH must be submitted within 30 calendar days of delivery of the product.
  6. If the warranty is applicable but is not indicated in the Product description, the warranty claim must be directed to the manufacturer or importer.
  7. If the User meets the conditions and considers that the warranty is valid, he/she must send an email to garantia@glowish.mx to assert his/her warranty. Instructions on the process to follow will be provided.


Promotions:

The User acknowledges that any advertisement, offer, publicity or promotion of GLOWISH will be subject to its own applicable terms and conditions. In order to benefit from or apply them, the User must consult and comply with these terms and conditions.
We reserve the right to refuse or cancel orders if there are any errors in the details of our promotions, such as prices, descriptions or availability of products, due to typographical, transmission or other errors, even after we have sent an order confirmation. In such cases, we will promptly inform you and refund any payments received without undue delay.

Notifications:

The User is responsible for being aware of the information sent, as the deadlines begin to count from the moment of notification. GLOWISH will not be responsible for data incorrectly provided by the User or for the inability to receive communications due to blocks in the email or other means of managing Personal Data. Likewise, GLOWISH cannot be held responsible for the User's omission in consulting said information.

Limitation of liability:

No Warranty: The information, materials and services provided on this website are provided "as is" and without warranties of any kind, either express or implied. We do not warrant the accuracy, completeness or reliability of any information or content on this website.

Use at Your Own Risk: Your use of this website and its content is at your own risk. We will not be liable for any damage or loss arising from your use of or reliance on any information, materials or services provided on this website.
