GLOWISH is a trademark of Infinity Brands S. de RL de CV, known as “INFINITY BRANDS”, with headquarters at Calle Tomás V. Gómez 182, Ladrón de Guevara, CP 44600 Guadalajara, Jalisco, Mexico, Federal Taxpayer Registry IBR2404012KA, hereby offers the terms and conditions that govern the use of the website www.glowish.mx and its electronic application (“website”). Therefore, any person who uses the website or purchases GLOWISH products (hereinafter, “User”) must comply with the provisions of this document.
The Controller issues this Privacy Notice so that the Owner of the personal data, hereinafter referred to as the “Owner”, is aware of the processing that the Controller carries out on his/her Personal Data, through any means and, in particular, in relation to the website www.glowish.mx, hereinafter, the “Page” or the “Site”.
Personal Data We Collect:
The data that the Controller collects from Data Subjects includes identification information, tax information, financial information and contact information. The Controller may require the “Data Subject” to verify the data provided and indicate their preferences regarding marketing communications.
Purposes of Personal Data Processing:
The Controller uses the Personal Data of the Owner to fulfill the following Purposes:
(i) Primary Purposes: These include the provision of services and products offered to the general public; processing requests made by the Owner in relation to the services and products offered; establishing a possible contractual relationship; complying with the rights and obligations of the parties in said relationship; ensuring the security of the client's operations and their identity; and complying with applicable provisions by integrating an identification and knowledge file. In addition, personal data is collected to resolve queries, complaints or claims, as well as to carry out measurements in order to offer, improve and promote products and services. All of these purposes are essential to establish the Legal Relationship.
(ii) Secondary Purposes: These include use for statistical purposes, as well as to offer, improve and promote products and services, and provide information of interest to the Owner.
If the Owner does not wish for his/her data to be used for the Secondary Purposes, he/she may send an email with the subject “Refusal Secondary Purposes” to the email address servicio@glowish.mx.
Transfer of Personal Information and Personal Data:
The Controller has the power to transfer the personal data of the owner to a national third party in the logistics, financial and fraud prevention sector, for the purpose of providing the services and products offered to the general public; to process requests made by the Owner in relation to said services and products, with a view to a possible contractual relationship; and to comply with the rights and obligations arising from said contractual relationship. It is important to note that said third parties may only use this information for the specific purposes mentioned for each of them. Since all these purposes have an original nature, it will not be necessary to obtain the consent of the Owner for the transfer, in accordance with the provisions of articles 36 and 37 of the Law on the Protection of Personal Data Held by Private Parties.
Exercise of ARCO Rights:
The Owner, either personally or through a Representative, has the right to request at any time Access, Rectification, Cancellation or Opposition to the personal data handled by the Controller.
To do so, the Holder must send a Request by email in a written document that meets the following Requirements:
(i) Name of the holder, address and email to receive the response.
(ii) Documents proving identity, such as a voter ID card, passport, military service card, or Immigration Card, attached as clear and legible images.
(iii) If sent through a representative, the representative's identification and a power of attorney signed by two witnesses must be presented, attaching clear and legible images of the power of attorney and identification.
(iv) Relationship that the Owner maintains or had with the Responsible Party.
(v) Clear and precise description of the personal data on which any right of access, rectification, cancellation or opposition will be exercised.
(vi) If necessary, the modifications to be made and the documentation supporting the request.
(vii) The letter must be addressed to the Controller and to the Controller's Privacy Department.
The Request will be sent to the Personal Data Area email: servicio@glowish.mx.
The Controller will communicate its decision to the Owner within 20 business days from receipt of the request, via the same email address. The Controller will be deemed to have received the request at the time it enters the server, and will respond with an Acknowledgement of Receipt.
Once the response has been sent within the established period, the Controller will have 15 business days to carry out the Access, Rectification, Cancellation or Opposition of the personal data as requested. The response, and if necessary, the sending of information, will be by email. If the Owner requests it and it is feasible, the information will be sent to the means indicated by the Owner, after paying the shipping or reproduction costs.
Limitation on Use or Disclosure of Personal Data:
If the Owner wishes to limit the use or disclosure of his/her personal data, but still wants to continue using the services and products of the Controller, he/she must state this in writing to the email address servico@glowish.mx, including the following information:
(i) Name of the holder, address and email to receive the response.
(ii) Documents proving identity, such as a voter ID card, passport, military service card, or Immigration Card, attached as clear and legible images.
(iii) If sent through a representative, the representative's identification and a power of attorney signed by two witnesses must be presented, attaching clear and legible images of the power of attorney and identification.
(iv) Relationship that the Owner maintains or had with the Responsible Party.
(v) Clear and precise description of the data whose use or disclosure you wish to limit.
(vi) The letter must be addressed to the Controller and to the Controller's Privacy Department.
The Request will be sent to the Personal Data Area email, servicio@glowish.mx.
Personal data that have already fulfilled their purpose but cannot be cancelled or deleted by legal or contractual provisions will be blocked to prevent misuse until they can be deleted. During this period, personal data will not be processed beyond their storage and safekeeping.
Use of Cookies or any technology to collect information:
The Controller uses cookies on the website. Cookies are data files that are stored on the hard drive of the computer or electronic communications device of a Data Subject while browsing a website. This allows status information to be exchanged between the website and the Data Subject's browser.
Status information may reveal user authentication or preferences, as well as any data stored by the browser regarding the website. Cookies cannot be used to obtain data from your hard drive, email address or any other private information; their function is to collect information about the Owner's behavior when visiting the website.
The installation, permanence and existence of cookies on the User's computer depends on his or her exclusive will and can be deleted from his or her computer whenever he or she wishes. Modifications to the Privacy Notice:
Both the Controller and the Data Subject acknowledge that this Privacy Notice is valid for an unlimited period of time. However, the Controller undertakes to keep this Notice up to date. Any changes to the Privacy Notice will be communicated to all Data Subjects in a general manner. These changes will be communicated to the Data Subject by means of a notice on the Controller's Website.
Consent:
Before providing his/her personal data, the Owner explicitly expressed his/her consent to this Privacy Notice, which was made available to him/her prior to the delivery of said information on the website.
Revocation of consent:
The Owner has the right to revoke his/her consent at any time regarding this Privacy Notice and the Processing of his/her Personal Data.
To revoke consent, the Holder must send a Request to the email address servicio@glowish.mx, which must be in writing and meet the following requirements:
(i) Documents proving identity, such as voter ID, passport, military service card or Immigration Card, attached as clear and legible images to the email.
(ii) In the event that the request is made through a representative, the representative's identification and a power of attorney signed by two witnesses to act on behalf of the holder must be included, attaching legible images of the power of attorney and identification.
(iii) Indicate the relationship that the Holder had or has with the Responsible Party.
(iv) The letter must be addressed to the Controller and to the Controller's Privacy Department.
The Controller will issue a response confirming the revocation of consent, or, where appropriate, will provide the reasoning depending on the specific case, having a period of 15 days to issue this response.
The deadlines will be counted from the moment the email enters our server, and the Controller will send an Acknowledgement of Receipt of the Request.
It is important to note that the Application will not be valid if the above-mentioned requirements are not met.
Internal Privacy Area:
The Data Subject may exercise his/her rights and make the queries mentioned in this document, as well as in the law, through the Data Controller's Privacy department. All Requests must be addressed to this area, in accordance with the provisions of this document and the Law.
The User must use the email address servicio@glowish.mx to contact the Privacy Department. The owner of the Privacy Department is Dieter Pfeffer.

Acceptance of Terms:
If you use the services of this site, it means that you have read, understood and accepted the terms set out above. If you do not agree with them, you should not provide any personal information.
